Shiffra/Green has been appealed to the Wisconsin Supreme Court and been upheld, most recently in July. It was upheld in 2013 in State v. Samuel Curtis Johnson, III, with four of the five judges agreeing it should not be overruled. In July of this year, the ruling was again upheld in State v. Patrick L. Lynch.
